Sergeant Major in the 11th Prince Alberts Own Royal Hussars
After 23 years in Queen Victoria's Army, Sergeant Major Leigh Lawton retires with a pension and gave his intended residence as New Zealand. He arrived in Melbourne, Australia on the 4th May 1874 with his wife and four daughters and a baby boy. The came on the ship "Pera" from Galle, a port in Ceylon to Australia, on their way to New Zealand. But apparently his wife Julia refused to re-board the ship, having been violently sea-sick the whole voyage. They are next heard of in Castlemaine in 1873 and then in Echuca in 1877 where they remained. Three more children were born in Victoria at Crossenvale near the Campaspe River. Leigh was reputed to have bred horses for the Indian Army after he retired to Australia.Occupation -

- I have yet to find any record of the Birth Date or Baptism date of this Luke Lawton. - This LUKE could be a son of James & Ann Howard of Bottoms.spouse: Bottomley, Sarah Ann (~1822 - 1860)
- The 1851 Census has Luke recorded as being 28 years of age which would equate to him being born 1823 - Could this be the same Luke Lawton born 1818 at Bottoms, son of Robert Lawton & Alice (Lees) Lawton. (Very Doubtful)

- LAWTON Luke - Died: Stayley, Cheshire - Tameside - 1876-STY/11/76
The Mossley and Saddleworth Reporter - 8th January 1876 - Death from falling down stairs,
The same jury who had sat in the above case next inquired into the death of Luke LAWTON, who met with his death suddenly on Saturday evening January 1st 1876, by falling downstairs at his own home while in a state of intoxication. "The following evidence was given:
Sarah BUCKLEY deposed that the deceased was her father. He resided with her at Bottoms Fold. He was about 55 years of age, and was employed as a labourer for Mr John MAYALL. He had a wife living at South Cottages, but they had not lived together for some time. The deceased was in the habit of coming home drunk. On Saturday evening she was in a neighbour's house when Samuel WOLFENDEN came and told her he had brought her father home, and put him in the chair. In a few minutes after she went into her house, and Mrs SMITH went with her. When she got in her father was going upstairs. She gave her child to Mrs SMITH, and got a candle to light her father upstairs. Just as she got to the foot of the stairs he, however, came tumbling down head first. His tie was over his face, and she pulled it away. He never spoke, and I screamed for help, and William SIDEBOTTOM was the first person to come.
John WOLFENDEN deposed to taking the deceased home on Saturday night, and placing him in the chair. He was drunk, and when he left him he had his elbow on the table, with his head resting on his hand. He afterwards went and told Mrs BUCKLEY he had brought her father home.
Betty SMITH gave evidence to the same effect.
Constable LOWE was sworn, and deposed that he was in the house directly after the accident occurred. Dr. SCHOFIELD was sent for, and he came. "After examining his head he said that he supposed he had died from contusion of the brain.
Edward NIELD, landlord of the house, said the deceased called at his house on Saturday night. He was partly drunk, but he had nothing to drink at his house, and never asked for anything. When they saw how he was they got John WOLFENDEN to take him home.
A verdict of "accidental death" was returned.

Hi Trevor
I recently came across some detail on a Mally Lawton which I thought might be useful to you to 'tidy' an area on your informative tree. The Mally b 1805 in Dobcross was the same Mally who married Samuel Wood in 1843 in Rochdale. They then went to live in Heyrod ( Ashton parish) where they can be found in 1851-71 censuses with 3 daughters, and then Samuel (under Woods) as a widower in 1881.
Interestingly Samuels's sister Mary Wood[1805-1892] married John Whitehead of Delph[1805-1873] and it was he who was the son of John Whitehead and Mary Lawton [1767-1829] b Delph in 1805Occupation -

- This 'MALLEY' is not the Daughter of Joseph and Hannah - Need to verify!
Some anomaly with this Mally - In the IGI she is recorded as the daughter of Joseph & Hannah Lawton baptised at Dobcross on 16th May 1805. - But in the Radcliffe Burial Register she is recrded as the daughter of John Lawton of Fairbanks, Diggle, buired 18th May 1805Burial - [date: 18 MAY 1805] [place: St. Chad's Saddleworth Churchyard.]
- St. Chad's Burial Register - 18th May 1805 - MALLEY LAWTON, Daughter of John Lawton of Fairbanks, Diggle. - [On the pages in the actual Register the records state which child died and was buried as an 'Infant' - This Malley was not recorded as an infant, so must have been much older] - Also her father is recorded as JOHN LAWTON and not Joseph Lawton of Fairbanks.Baptism - [date: 16 MAY 1805] [place: Holy Trinity Church, Dobcross, Saddleworth, Yorkshire.]
