This is the Last Will and Testament of me ROBERT LAWTON of Bottoms within Stayley in the County of Chester - Cloth Manufacturer. I appoint my relative JAMES LAWTON of Mossley Brow in the Parish of Ashton-under-Lyne in the County of Lancaster - Bookkeeper, and my friend JAMES DYSON of Mossley in the Parish of Ashton-under-Lyne aforesaid - Draper, trustees and executors of this my Will.


I devise unto my said trustees; All that my freehold plot of land and Eight messuages or dwelling houses erected thereon in Stayley aforesaid and fronting or adjoining to a Street intended to be called 'Cheshire Street', and I bequeath unto my said trustees all my personal estate upon thereunto the following (Namely). Upon trust to collect the rents of two of my said messuages adjoining to the property of my daughter CAROLINE the wife of BENJAMIN BUCKLEY which said messuages are now in the occupation of GEORGE HINCHLIFFE and ANN LEES respectively, and to pay the same rents unto or permit my said daughter CAROLINE to receive the same during her life for her separate use and benefit, subject to the payment of one third part of the yearly ground rent payable to the Earl of Stamford & Warrington in respect of the plot of land forming the site of such messuages, and upon the death of my said daughter CAROLINE to stand seized of the said two messuages, In Trust, for all and every the children of my said daughter CAROLINE who shall live to attain the age of twenty one years, equally, with the power to my said trustees during the minority of any of the children of my said daughter to apply the rents of the said messuages in and for the maintenance and education of such children respectively as my said trustees in their discretion shall think expedient.


And upon trust that they my said trustees shall collect the rents of Three other of my said messuages now in the several occupations of BETTY DEMPSEY, SARAH BUTLER and GEORGE LESTER, and pay the same rents unto or permit my daughter MARGARET the wife of CHARLES MOSELY to receive the same during her life for her separate use and benefit, subject to the payment of the other third part of the said yearly ground rent, and upon the death of my said daughter MARGARET, Upon Trust, to stand seized of the said three messuages in trust for all and every the children of my said daughter MARGARET who shall live to attain the age of twenty one years, equally, with the power to my said trustees during the minority of such children to apply the rents of the said messuages in and for the maintenance and education of such children respectively, as my trustees shall in their discretion think expedient. Provided Always, that in case my said daughter or either of them shall die without leaving issue who shall attain the age of twenty one years, then and is such case I declare that the messuages and hereditaments intended for such daughter so dying, and her issue shall be held by my trustees, Upon Trust, for the husband of each such daughter during his life and subject thereto, Upon Trust, to pay one equal moiety of the rents or annual income thereof unto the survivor of my said daughters during her life, and on the death of such surviving daughter to hold one equal moiety of the said messuages and hereditaments In Trust for the children of such surviving daughter equally. And to pay the remaining moiety of the said messuages and hereditaments, In Trust, for the children of my late son LUKE LAWTON in equal shares, and upon trust that my said trustees shall collect the rents of the remaining Three of my said messuages in the several occupation of JAMES SCHOFIELD, MARY LAWTON and WILLIAM WOOD, and apply the same rents for the maintenance and education of all and every the said children of my said son LUKE LAWTON during their respective minorities, and shall stand seized of the said three last mentioned messuages, In Trust, for all and every the children of my said late son LUKE LAWTON who shall live to attain the age of twenty one years in equal shares.


And in case all the children of my said late son LUKE LAWTON shall die under the age of twenty-one years, then I direct that the rents of the said messuages intended for such children shall be paid to MARY LAWTON the Widow of my said late son during her life.


And I direct that all the Necessaries erected by me upon the said plot of land and the vacant land shall be enjoyed in common by the persons beneficially interested in the said messuages for the time being. And I direct my said Executors to pay and divide my personal estate in manner following (Namely). One equal third part thereof unto my daughter CAROLINE, one other equal third part thereof to my daughter MARGARET, and the remaining equal third part thereof unto and equally amongst such of the children of my late son LUKE LAWTON who shall live to attain the age of twenty one years. - This ROBERT LAWTON (Woollen Cloth Manufacturer) was to experience many changes throughout his lifetime. With the advent of the Industrial Revolution and the development of First the Huddersfield Narrow Canal being constructed alongside the River Tame at Bottoms between the years 1792 through to 1811 when the Canal was finally opened. Then Secondly, the advent of the Railways, and the Stalybridge. Micklehurst, Diggle Loop Line being constructed betweem the years 1845 to 1849 - These developments were to have dramatic impact and consequences for the 'LAWTON's of Staley Bottoms, as they resumed much of their landholdings along the Tame River floodplain and bankings. Much good arable land and pastures of the Estate would be destoyed and lost forever, but no doubt they would have been compensated for such a loss, one woult think.
