In January 1745, Anne Lawton, Widow & Relict of the above named John Lawton deceased made oath well and truly to execute and perform the last Will and Testament of the said Deceased, and that the Goods and Chattels of the ( ) Deceased did not extend to the sum of Twenty Pounds before Mr John Heginbottom Surr.- NOTE from Edward Felton - I have taken little interest in the recent exchange of emails between you, Ian Lawton and Lilyann Durkee because I didn't think their Lawtons were linked to mine.
But in your latest email you infer that John Lawton (1745 Will) was their ancestor. You probably didn't know that he was also an ancestor of my wife (and also Donald Beattie and Linda Baylis) through his daughter Sarah, who married William Rhodes in 1740. I had not discovered anything of this John Lawton before the 1745 will. I am interested that in an email you declare him to have been born in 1679 and to have married Mary Whitehead. But his will states his wife as Anne when he died. What is the evidence that these three John Lawtons (born 1679, married Mary Whitehead, married Anne and died in 1745 are one and the same person? This is the Last Will and Testament of JOSEPH LAWTON of Ponge, within the Parish of Mottram in the County of Chester - Woollen Manufacturer. *[Ponge Houses, Micklehurst Rd.]
First I give, devise and bequeath unto my beloved wife NANCY LAWTON, two Cottages or Dwelling Houses with the Appurtances, situate at 'Lane' in the Parish and County aforesaid, in the respective occupation of Thomas Howard and John Broadbent *[At EarnshawLane], to have and to hold the same during her natural life, and from and after her decease, I give, devise and bequeath the said Cottages or Dwelling Houses with the appurtances unto HANNAH LEES, wife of JAMES LEES - ALICE LAWTON and SARAH LAWTON, being the children of my Brother JOHN LAWTON, to have and to hold the said property and appurtances to and for their respective uses, intents and purposes as tenants in common. But if it should happen that any of the said children should die without issue, then and in such case, I direct that the freehold Cottages beforementioned with the apputances shall be divided equally amongst the survivors or suvivor of them.

Josiah Lawton was in fact the innkeeper of the Swan Inn, Dobcross from 1796-1832 and succeeded his father Benjamin Lawton previous innkeeper and founder of the pub. His initials can still be seen over the doorway of its former location BL 1748. Josiah was succeeded by his widow Esther until 1838 when their son Thomas took over as licensee. Thomas closed the pub and moved into the Kings Head across the road in 1859 combining the names of the Swan Inn and Kings Head. The former name was adopted in the 1920s but Kings Head can still be seen on the glass entrance door. There is an excellent account of the pub and the Lawtons connection with it in the book Saddleworth Pubs by Rob Magee.

In his book 'Saddleworth Building', W. John Smith describes a 'byre door' in a three-storey warehouse, which can be seen in a narrow entry across from to-day's Swan Inn. The lintel above the door is inscribed 'BL 1748. 'BL' was Benjamin Lawton, innkeeper at the original Swan Inn. There are records showing that a John Lawton and his son Josiah acquired an acre of land here in 1719, and there was a cottage on the land by 1728, but the earliest evidence of an inn comes from the Manchester Mercury newspaper in 1755, when 'the house of Benjamin Lawton of Dobcross' was mentioned in a sale notice. The Swan Inn is first mentioned by name in an auction advertisement published in 1769.
Licensing records show that Benjamin Lawton failed to attend the sessions in 1771 and was marked 'absent' and 'excluded'. He turned up in 1773, but by 1777 he was considered 'old'; Joseph Winterbottom and Joseph Lawton (of the Woolpack Inn, Dobcross) were his sureties. In subsequent years, Benjamin was recorded as 'old' and 'absent', but he continued to run the Swan Inn until about 1796. His son Josiah Lawton then took over the license.
By the end of the eighteenth century there was a variety of buildings on the acre which the Lawton's had acquired back in 1719. According to a deed of 1815, the Swan Inn stables stood on some land, which Benjamin Lawton had given to a Molly Hegginbottom. Another deed (1829) names the inn as 'The Swan with Two Necks' and lists a barn, stables, cowhouses, a shop, cellars, and a newly erected wool warehouse, all tenanted by Josiah Lawton, together with a house and shop tenanted by a George Fielder.
As well as being an Innkeeper, Josiah Lawton is listed as an 'Agent' and 'Commissioned Woolseller' in the 1818-20 business directories. By 1836 however, Josiah's third wife, now widow, Esther (Hegginbottom) Lawton had the license, and the 1841 Census found Thomas Lawton (son of Josiah and 2nd wife Betty Hurstwood) in charge. He was still there 10 years later, along with his wife Jane (Platt) Lawton and eight children. The eldest, Elizabeth, was a barmaid and her sister Hannah was a Waitress.
By the late 1850's time was running out for the Swan Inn. The railway had made long distance horse & coach travel obsolete, and now there were plans to build 'Dobcross New Road' which would by-pass the village with Delph New Road, by connecting New Delph with Uppermill through the Vale of Tame. The nearby Kings Head Inn was better situated at the crossroads in the village so in 1859 Thomas Lawton bought the property.
At the licensing sessions in January 1859, Thomas Lawton transferred the Swan Inn license to Ebenezer Rhodes and at the next licensing transfer sessions he took the license of the Kings Head. Thomas must have been fond of his old Inn sign, as he seems to have taken it with him, and the Kings Head Inn became the 'Swan with Two Necks'. The original Swan Inn was managed by Ebenezer Rhodes for a few months and then the license was allowed to lapse at the transfer sessions.
The old Swan Inn became a private house, the residence of Dr. Ramsden. A deed of 1885 describes the property as 'that messuage or tenement formerly used as an inn called 'The Swan with Two Necks' with barn, stables, brewhouse, cellars and wool warehouse.

Thanks again for your considerable help....interested to see part of Josiah s family may have gone to USA. In 1965, was amazed to see 16 pages of Lawton s inNew York phone directory (didn't phone any!) then in 1980 at Albany NY state library a whole library card drawer full of them! As I say worse than Oz rabbit plagues!
For moment,cheers TL. You will have noticed from small range of surnames above, these were pretty well all the offspring of original land selectors from 1860 s on small holdings surrounded by Roman Catholics....even in the villages there were strong demarcations! The
Lawtons, Lanhams and Lees formed a small Methodist belt...the Lees were originally from Germany, NOT Saddleworth.

Sadly there was a second mining accident in the family which led to Fred's death on 14 April 1932. It would appear that he took his own life after receiving a painful and blinding eye injury at Manvers Main colliery ten days earlier. He was buried at St. Margaret's on 18 April. Annie was awarded ?600 in compensation by the court. I traced Annie and some of her children as far as the National Register on 29 September 1939. Her date of birth differs from the one I gave you before which was taken from a school admission register. I wonder how much Annie did know about her early life because the 1911 census says "Not Known" against her place of birth.

I found Annie's marriage to Fred Law, a coal miner, at St. Margaret's Church, Swinton on 3 June 1908. Fred was already living in Fitzwilliam Street and the Law family were at number 28 in the 1911 Census when the first two of their children were born: Mary Kate in 1909 and Walter on 28 September 1910. Three more children would follow: Ernest 5 April 1918, Alfred 15 December 1924 and Betsey in 1931.

Not found in the 1841 Census of Saddleworth when about 27 years of age, so suspect Abraham moved from Saddleworth before that date. - There is a record in the New York, Passenger and Immigration Lists, 1820-1850 about an Abram Lawton who emigrated to the USA in 1838 - Name: Abram Lawton - Arrival Date: 31 Dec 1838 - Age: 24 - Gender: M (Male) - Port of Arrival: New York - Port of Departure: Liverpool - Place of Origin: Great Britain - Occupation: Butcher - Ship: Ship "Sheridan" .
In the 1851 Census - This Abram Lawton is found living as a Lodger with Timothy Lockett a Farmer of 82 acres, on School Lane, at Chelford, Alderley in Cheshire. He is listed as a County Police Officer and born in Saddleworth, Yorkshire. In an article in the Liverpool Times of the 28th March 1853 there is a report of Abraham Lawton having committed 'Suicide' near the front gate to his residence at about 6.a.m. that day. The injury was so severe that the newspaper reported that he had ' nearly severed his head from his body' and that he had " he had complained for several days previous of a pain in his head". Later the same day an Inquest was held, and they came to the suicide 'verdict' of 'temorary insanity. I obtained his death certificate dated 29th March 1853, and it says 'Cut his throat being insane' . From all this information it seems that his Death, Inquest and Newspaper article all happened on the same day. What ever happened to investigative Police Work!, Surely we are dealing with Murder! I have yet to find documents relating to the incredibly quick Inquest, to find out what was siad and by whom (2011) - I have made enquires with various depositiries and it seems the Inquest papers whould have been destroyed within six months of the inquest, which apparently is quite normal for such documents, both then and now!!
